The Right to Refuse Unsafe Work.

Construction is one of the most dangerous industries, with hundreds of fatal accidents each year due to workers not understanding their rights and responsibilities. Ensuring that workers know their right to refuse unsafe work is essential for creating a safer work environment and preventing tragedies. This right empowers workers to speak up when they feel their safety or the safety of others is at risk.

Refusing Unsafe Work

Work may be refused if it is likely to cause serious harm. It is illegal for employers to retaliate against workers who refuse unsafe work. If you reasonably believe a task is hazardous, follow these steps:

  • Report the Issue: Immediately inform your supervisor or employer about the unsafe condition. Provide detailed information about the risk.
  • Employer Investigation: The employer must investigate and either address the issue or confirm that the work is safe.
  • Seek External Assistance: If the problem remains unresolved, you can contact regulatory authorities to assess the situation.

Workers cannot be disciplined for following the proper refusal process. Temporary alternative work with pay may be assigned until the matter is resolved. Remember, your safety is paramount, and voicing concerns helps create a safer workplace for everyone.
